It has been clarified that in September 2025, former Chief Justice Sophia Akuffo sent in her letter of resignation from the Council of State.<\/p>\n

She hasn’t gone to any Council of State sessions since.<\/p>\n

In addition to being one of the 31 members of the current Council of State advisory council, which is presided over by former Speaker of Parliament Edward Doe Adjaho, Justice Sophia Akuffo was Chief Justice from 2017 to 2020.<\/p>\n

In accordance with the 1992 Constitution, which stipulates that a former Chief Justice should be a member of the Council, she had earlier this year made it clear that she was sitting on the Council of State in her personal capacity as a former Chief Justice rather than on behalf of the Judiciary.<\/p>\n

Former<\/span>\u00a0Chief Justice Sophia Akuffo\u00a0submitted<\/span>\u00a0her\u00a0resignation<\/span>\u00a0from the Council of State in September 2025.<\/span>Since that\u00a0time<\/span>, she has not\u00a0participated<\/span>\u00a0in any\u00a0meetings<\/span>\u00a0of the Council.\"\"<\/a><\/span><\/p>\n

Justice Akuffo\u00a0served<\/span>\u00a0as Chief Justice from 2017 to 2020 and was one of the 31\u00a0members<\/span>\u00a0of the\u00a0current<\/span>\u00a0Council of State, which is\u00a0chaired<\/span>\u00a0by\u00a0former<\/span>\u00a0Speaker of Parliament Edward Doe Adjaho.<\/span>
\nShe had\u00a0previously<\/span>\u00a0clarified<\/span>\u00a0that she was not\u00a0representing<\/span>\u00a0the Judiciary on the Council, but was\u00a0serving<\/span>\u00a0in her\u00a0own<\/span>\u00a0capacity<\/span>\u00a0as a\u00a0former<\/span>\u00a0Chief Justice, as\u00a0stipulated<\/span>\u00a0by the 1992 Constitution, which\u00a0outlines<\/span>\u00a0that a\u00a0former<\/span>\u00a0Chief Justice should be a\u00a0member<\/span>\u00a0of the Council of State.<\/span><\/p>\n

Her\u00a0decision<\/span>\u00a0to\u00a0resign<\/span>\u00a0came<\/span>\u00a0after she\u00a0expressed<\/span>\u00a0a\u00a0differing<\/span>\u00a0opinion<\/span>\u00a0during a\u00a0vote<\/span>\u00a0in April 2025\u00a0regarding<\/span>\u00a0whether a\u00a0prima<\/span>\u00a0facie<\/span>\u00a0case<\/span>\u00a0had been\u00a0established<\/span>\u00a0against a\u00a0petition<\/span>\u00a0seeking<\/span>\u00a0to\u00a0remove<\/span>\u00a0then<\/span>-Chief Justice Gertrude Torkornoo from\u00a0office<\/span>.<\/span><\/p>\n

Following<\/span>\u00a0this, she\u00a0appeared<\/span>\u00a0before the\u00a0Article<\/span>\u00a0146\u00a0committee<\/span>\u00a0at the\u00a0request<\/span>\u00a0of the\u00a0then<\/span>–suspended<\/span>\u00a0Chief Justice Torkornoo to\u00a0provide<\/span>\u00a0testimony<\/span>\u00a0in her\u00a0defense<\/span>.<\/span>
\nIn an\u00a0interview<\/span>\u00a0in September 2025, Justice Akuffo\u00a0criticized<\/span>\u00a0the\u00a0proceedings<\/span>,\u00a0stating<\/span>\u00a0that Chief Justice Torkornoo had not\u00a0received<\/span>\u00a0a\u00a0fair<\/span>\u00a0hearing<\/span>.<\/span>She\u00a0described<\/span>\u00a0the\u00a0process<\/span>\u00a0as a “treason<\/span>\u00a0trial<\/span>,”\u00a0warned<\/span>\u00a0that it had\u00a0weakened<\/span>\u00a0the\u00a0judiciary<\/span>, and\u00a0argued<\/span>\u00a0that the\u00a0allegations<\/span>\u00a0against Torkornoo were not\u00a0serious<\/span>\u00a0enough<\/span>\u00a0to\u00a0justify<\/span>\u00a0removing<\/span>\u00a0the\u00a0head<\/span>\u00a0of a\u00a0judicial<\/span>\u00a0institution<\/span>.<\/span>

\nThe Council of State is a\u00a0constitutional<\/span>\u00a0body<\/span>\u00a0tasked<\/span>\u00a0with\u00a0advising<\/span>\u00a0the President on\u00a0matters<\/span>\u00a0of\u00a0national<\/span>\u00a0significance<\/span>.<\/span>
\nPresident Mahama\u00a0accepted<\/span>\u00a0Justice Akuffo\u2019s\u00a0resignation<\/span>\u00a0as a\u00a0member<\/span>\u00a0of the Council of State, and the\u00a0process<\/span>\u00a0to\u00a0replace<\/span>\u00a0her is\u00a0currently<\/span>\u00a0underway<\/span>.<\/span><\/p>\n

In a\u00a0press<\/span>\u00a0briefing<\/span>\u00a0at the\u00a0presidency<\/span>\u00a0on June 15, 2026, the Government Communications Minister and Presidential Spokesperson, Felix Kwakye Ofosu,\u00a0confirmed<\/span>\u00a0that Justice Akuffo had\u00a0submitted<\/span>\u00a0her\u00a0resignation<\/span>\u00a0letter<\/span>\u00a0in September 2025 to the President.\"\"<\/a><\/span>
\nHe\u00a0stated<\/span>\u00a0that she did not\u00a0provide<\/span>\u00a0a\u00a0specific<\/span>\u00a0reason<\/span>\u00a0for\u00a0resigning<\/span>.<\/span>When the President\u00a0received<\/span>\u00a0the\u00a0letter<\/span>, he was\u00a0expected<\/span>\u00a0to\u00a0accept<\/span>\u00a0it, but the Council of State\u00a0requested<\/span>\u00a0that he\u00a0delay<\/span>\u00a0the\u00a0acceptance<\/span>\u00a0to\u00a0engage<\/span>\u00a0with Justice Akuffo to\u00a0understand<\/span>\u00a0any\u00a0grievances<\/span>\u00a0she may have\u00a0had<\/span>\u00a0and whether they could be\u00a0resolved<\/span>.<\/span>After\u00a0discussions<\/span>, the Council\u00a0concluded<\/span>\u00a0that the\u00a0resignation<\/span>\u00a0could be\u00a0accepted<\/span>, and the President\u00a0formally<\/span>\u00a0accepted<\/span>\u00a0it,\u00a0resulting<\/span>\u00a0in Justice Akuffo\u00a0no<\/span>\u00a0longer<\/span>\u00a0being a\u00a0member<\/span>\u00a0of the Council of State.<\/span><\/p>\n

The\u00a0law<\/span>\u00a0clearly<\/span>\u00a0outlines<\/span>\u00a0the\u00a0procedures<\/span>\u00a0for\u00a0replacing<\/span>\u00a0her, and a\u00a0replacement<\/span>\u00a0for Justice Akuffo will be\u00a0announced<\/span>\u00a0in\u00a0due<\/span>\u00a0course<\/span>.<\/span><\/p>\n
